Political persecution: protection against abuse of the Interpol system

Interpol was created as an instrument of global cooperation to combat common crime. However, in recent years, cases have been increasingly recorded when authoritarian regimes or unscrupulous competitors use organizational mechanisms to put pressure on opponents and businessmen. A politically motivated search is a direct abuse of the international justice system.

SAFEWAY ADVISORY (SWA) experts remind that international law provides for strict filters to protect citizens from such manipulations, and a key role in their activation is played by an interpol specialist lawyer.

How does the Interpol system become a weapon of persecution?

Abuse of the system usually occurs in two scenarios:

  1. Direct prosecution: Initiation of cases under purely political articles (treason, extremism, participation in uncoordinated organizations). Interpol’s central office in Lyon usually blocks such requests at the moderation stage.

  2. Veiled (indirect) persecution: This is a more dangerous and common method. A classic economic case is being fabricated against a person (fraud, tax evasion, embezzlement). At first glance, the request looks legitimate, but its real purpose is the destruction of a political opponent, imprisonment or raider seizure of assets.

Protection mechanisms: Articles 2 and 3 of the Charter

The main barrier to illegal requests is the fundamental norms of the organization itself. The defense is based on two “pillars”:

  • Article 2 of the Interpol Statute: Requires that all activities of the organization strictly comply with the Universal Declaration of Human Rights. If the defendant faces a biased trial or torture in the requesting State, the search is considered illegal.

  • Article 3 of the Interpol Statute: Establishes a categorical prohibition on any interference in matters of a political, military, religious or racial nature.

The role of an international lawyer in combating abuse

It is almost impossible to independently prove to the File Control Commission (CCF) that your business has a hidden agenda. What is needed for Lyon is not emotions, but a systematic legal analysis.

An experienced interpol lawyer from the SWA team builds protection in the following areas::

  1. Identification of the “political context”. We collect evidence that the persecution began immediately after your public activism, criticism of the authorities, or refusal to transfer the business to affiliated structures.

  2. Analysis of judicial practice. We refer to the decisions of the ECHR, reports of the United Nations and international human rights organizations confirming that the requesting State systematically uses specific criminal articles to crack down on independent entrepreneurs.

  3. Preventive protection. If the risk of fabricating a case is high, we send a proactive dossier to the CCF before your name appears on the screens of the border guards. This blocks the automatic publication of Red Notice.

Safety according to the SWA standard

In the face of political or corporate pressure, data privacy is crucial. In SAFEWAY ADVISORY, all processes are organized according to the Privacy by default principle. Your information is protected from leaks at any stage of the case.
